Terms of Service

IMPORTANT NOTICE

CardWallet is provided entirely free of charge. By downloading, installing, accessing, or using the App, you agree to be legally bound by these Terms of Service. If you do not agree, you must not use the App.

1. Acceptance of Terms

By using CardWallet ("the App" or "Service"), you enter into a legally binding agreement with the operator of CardWallet, Jittercat ("we", "us", or "our"). These Terms apply to all users without exception.

If you do not agree to these Terms, you must immediately discontinue use of the Service and remove the App from your device.

2. Description of Service

CardWallet is a loyalty and membership card holder application that allows users to store and display digital representations of loyalty, rewards, and membership cards.

The Service includes local device storage, barcode and QR code display, card organization tools, and an optional user-initiated backup feature.

CardWallet is NOT a payment app, banking service, financial product, or digital wallet. It does not process payments, store money, facilitate financial transactions, or interface with financial institutions.

The Service is provided entirely free of charge.

CardWallet is intended solely as a convenience tool and is not a replacement for physical cards.
Users must retain and safeguard all physical cards independently.
CardWallet does not guarantee data preservation, backup success, or recoverability.
Barcode and QR code recognition is provided as a convenience only and may not be accurate in all cases; users must verify detected card details before relying on them.

3. AS-IS and AS-AVAILABLE Service

The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind.

We make no guarantees regarding availability, uptime, functionality, barcode acceptance, backup success, synchronization timing, data integrity, or restoration reliability.

Use of the Service is entirely at your own risk. CardWallet assumes no responsibility for any losses arising from use of the App.

4. User Responsibilities and Acceptable Use

4.1 General Obligations

You agree to use the Service lawfully, store only cards you are authorized to use, secure your device, and comply with all applicable laws and third-party rules.

4.2 Prohibited Activities

You may not use the Service to commit fraud, impersonate others, reverse engineer the App, bypass security, store illegal content, or access the Service using automated tools.

4.3 Prohibited Sensitive Information

You must not store credit or debit card numbers, bank details, payment references, PINs, CVV/CVC codes, passwords, cryptographic keys, authentication secrets, or any sensitive financial or security-related information.

CardWallet is not designed to store sensitive data. Any attempt to do so is strictly prohibited and undertaken entirely at your own risk.

4.4 High-Risk Cards and Financial Loss

CardWallet is intended only for low-risk loyalty and membership cards. You must not store bank cards, payment cards, or cards redeemable for cash or monetary value.

We accept no responsibility for any loss of funds, rewards, points, credits, or unauthorized redemptions.

4.5 Sharing Loyalty Cards

If you share loyalty or membership cards, you are solely responsible for ensuring such sharing is permitted by the provider. CardWallet does not verify third-party rules and accepts no responsibility for any resulting consequences.

4.6 Card Accuracy and Verification

You acknowledge that barcode and QR code detection, whether from camera capture, image upload, or manual entry, may be affected by image quality, lighting conditions, printing defects, non-standard barcode formats, or provider-specific implementations.
You are solely responsible for verifying that all scanned, detected, or displayed card numbers and codes are correct and match the original physical or official digital card before use.
CardWallet does not guarantee the accuracy, completeness, or acceptability of scanned barcodes or QR codes, particularly where card providers use damaged, poorly printed, low-quality, or non-standard barcodes that may not scan reliably.
CardWallet shall not be liable for any rejection, failure, loss of rewards, points, benefits, or other consequences resulting from incorrect, unreadable, or improperly detected card data.

5. Limitation of Liability

To the maximum extent permitted by law, CardWallet’s total cumulative liability for all claims, damages, or losses shall not exceed one South African Rand (ZAR 1.00), collectively, for the lifetime of the App.

This limitation includes, without limitation, any loss related to cloud backups, third-party storage services, Google Drive access, data loss, or restoration attempts.

6. Disclaimer of Warranties

All warranties, express or implied, are disclaimed to the fullest extent permitted by law.

7. Indemnification

You agree to indemnify and hold harmless CardWallet and its operator from all claims, damages, liabilities, and costs arising from your use of the Service or violation of these Terms.

8. Data and Privacy

You retain ownership of your data. Use of the Service is governed by the Privacy Policy.

8.1 Optional Google Drive Backup Disclaimer

CardWallet may offer an optional backup feature allowing users to export or synchronize data to their personal Google Drive account.

CardWallet does not provide, operate, host, manage, or control any cloud storage service. All backups occur solely within the user’s own Google Drive account and are subject to Google’s terms, availability, security, rate limits, and policies.

Backups are provided strictly on a best-effort basis. We do not guarantee that backups will occur, complete successfully, occur instantly, or occur at any specific time or frequency.

You are solely responsible for:

CardWallet accepts no responsibility for failed, delayed, incomplete, overwritten, corrupted, or missing backups.

9. Intellectual Property

All intellectual property rights in the App belong to CardWallet. You are granted a limited, revocable, non-commercial license to use the Service.

10. Service Changes and Termination

We may modify, suspend, or terminate the Service at any time without notice. You may stop using the Service at any time by deleting the App.

11. Third-Party Services

The Service may integrate with third-party services, including Google Drive and Google authentication services. We are not responsible for the availability, security, or performance of third-party services.

12. Force Majeure

CardWallet shall not be liable for any failure, delay, interruption, suspension, data loss, or inability to perform its obligations under these Terms where such failure or delay results, directly or indirectly, from events or circumstances beyond its reasonable control.
Such events include, but are not limited to, acts of God, natural disasters, fire, flood, earthquakes, pandemics, war, terrorism, civil unrest, labor disputes, governmental actions or restrictions, changes in law or regulation, court orders, power failures, telecommunications failures, internet outages, infrastructure failures, cyberattacks, denial-of-service attacks, malware, ransomware, security breaches, failures of third-party platforms, APIs, authentication providers, cloud storage services (including Google Drive), hosting providers, operating system limitations, app store restrictions, or failures of external networks or services.
During any such event, CardWallet’s obligations shall be suspended for the duration of the event, and CardWallet shall not be deemed in breach of these Terms. CardWallet does not guarantee restoration of Service, data, backups, or functionality following a force majeure event.

13. Dispute Resolution and Arbitration

To the maximum extent permitted by applicable law, any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, the Service, or the use of CardWallet, whether based in contract, delict (tort), statute, misrepresentation, or any other legal theory, shall be resolved exclusively by final and binding arbitration.
The arbitration shall be conducted in the Republic of South Africa, in accordance with the rules and procedures determined by CardWallet, unless otherwise required by applicable law. The arbitration shall be conducted on an individual basis only.
You agree that arbitration shall be the sole and exclusive forum for resolving disputes, and you waive any right to initiate or participate in any lawsuit, court proceeding, or class, collective, or representative action against CardWallet, except where such waiver is prohibited by law.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms, including any claim that all or part of these Terms is void or unenforceable.
The user shall be solely responsible for all legal fees, arbitration fees, administrative costs, and expenses arising from or related to any dispute, claim, or arbitration initiated by the user, to the maximum extent permitted by applicable law.
Any arbitration award shall be final and binding and may be entered and enforced in any court of competent jurisdiction.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

15. Class Action Waiver

You waive any right to participate in a class or collective action.

16. Device and Security Responsibility

You are solely and entirely responsible for securing your device, operating system, applications, accounts, and credentials used in connection with the Service.
CardWallet does not provide device-level security and is not responsible for any loss, damage, unauthorized access, or data compromise resulting from device theft, loss, unauthorized access, malware, spyware, ransomware, viruses, outdated software, insecure configurations, or failure to implement reasonable security measures.
CardWallet does not have access to, cannot view, monitor, inspect, retrieve, or otherwise see any cards, data, or content that you store in the App. Card data is stored locally on your device and, if you enable optional backups, exclusively within your personal Google Drive account.
CardWallet does not operate, maintain, or control any servers for storing user card data, does not receive copies of backups, and does not process or retain user content on its own infrastructure.
You are solely responsible for securing your Google account, maintaining appropriate access controls, safeguarding credentials, managing permissions, and ensuring the security, availability, and integrity of your Google Drive account.
CardWallet shall not be liable for any loss, corruption, deletion, unauthorized access, disclosure, or unavailability of data resulting from device compromise, Google account compromise, revoked permissions, insufficient storage, third-party service failures, or any security incident beyond CardWallet’s reasonable control.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CardWallet, which is owned and operated by Jittercat, regarding your use of the Service.

18. Updates to Terms

We may update these Terms at any time. Continued use constitutes acceptance.

By using CardWallet, you acknowledge that you understand and accept these Terms and assume full responsibility for any data stored or backed up using the Service.
